CONFIDENTIAL MINUTES

The Executive Session of the City Council of the City of Hackensack held on Tuesday, January 22, 2013 was called to order at 6:50 p.m.

Present: Mayor Michael R. Melfi, Deputy Mayor Marlin G. Townes, Jr., Councilman John P. Labrosse, Councilwoman Karen K. Sasso, Councilman Jorge Meneses, City Manager Stephen Lo Iacono and City Attorney Joseph Zisa.

Mr. Lo Iacono said that he had met with Michael Mordaga this afternoon with reference to the position of police director.

Mr. Lo Iacono also spoke about the need for promotions within the police department. He also said that he had received a letter from Anthony Ferraioli threatening litigation. He further said that he would like to make the appointments prior to Friday.

A brief discussion was held with reference to Captain Garcia’s legal fees. Raymond Wiss, Esq. and Dennis Calo, Esq. will be present at the February 4, 2013 work session to discuss same.

Mr. Lo Iacono indicated that at the February 5, 2013 meeting Nancy Kist, Esq. will have documents for redevelopment that must be acted upon. Nancy Kist, Esq. will also be at the February 4, 2013 work session.

Mr. Zisa advised that an amended complaint had been filed with reference to the Israelite Church.

Mr. Zisa also advised that the Sarapuchiello matter was done and that it had been a win for the City. He offered kudos to our retired people, as well as Dawn Hoffman, who he stated was amazing.

Mr. Zisa said that the Wiggins case is on-going and that Steven Gelber has filed a new OPRA suit.

Mr. Zisa also said that there is an opportunity for the City to buy out of the Passaic Valley litigation with a $95,000 payment.

Mr. Lo Iacono said that he had received an e-mail from Wendy Wiebalk, Esq. at Eric Bernstein’s office saying that she is leaving the office. Mr. Lo Iacono feels that the case that Ms. Wiebalk is handling should go with her if she is able to keep it with her, otherwise another attorney will need to be found to handle same.

Mr. Lo Iacono said that he had received a phone call from the Attorney General’s office regarding Johnson Avenue and that Chris Diktas, Esq. will set up a meeting with Mr. Mellone this week.

Councilwoman Sasso left the room as the DiPasqua case was about to be discussed. Mr. Zisa said that Judge Conte heard the case on January 7, 2013 and that the case is being dismissed without prejudice and is being sent to the construction official if they want to advertise Dunkin Donuts corporate. Councilwoman Sasso had received approval from the state for a three-sided sign, however the billboard ordinance is ambiguous and the new zoning board attorney will need to draft a new one.

A RFQ will be issued for a new zoning board attorney.

With reference to the parking issue on Union Street, the possibility of painting lines to map out parking spaces was discussed. This matter may possibly be referred to Len Bier. It was agreed to refer the matter to Fran Reiner for review.

Mr. Lo Iacono advised the Council that the Tax Collector’s office will need trained personnel to fill in at tax time while Luz Alvarez is away for a family emergency.

Mr. Lo Iacono also advised that the elevator at the Masonic Lodge is awaiting inspection.

There being no further business, the meeting adjourned at 7:45 p.m.
