INSTRUCTIONS TO COMPLETE DISTRICT CIVIL (CV) CASE COVER SHEET JDF 601 FOR INITIAL PLEADING OF COMPLAINT, COUNTERCLAIM, CROSS-CLAIM, OR THIRD PARTY COMPLAINT

GENERAL INFORMATION

The JDF 601 Case Cover Sheetis required for all District Civil (CV) actions. It must be filed with any pleading containing an initial claim for relief(Complaint, Counterclaim, Cross-claim, or Third Party Complaint). See C.R.C.P. 16.1(b)(3).

If you fail to file a required Case Cover Sheet, the Court will notify you and provide a deadline for filing one. If you do not meet the deadline, the Court may impose sanctions, including striking the pleading.

STEPS TO COMPLETE CIVIL CASE COVER SHEET

Step 1:Complete Caption.

Identify the name of the county and provide the court address where you plan to file your papers.

Identify the name of the Plaintiff(s) and Defendant(s) in the case. If there are multiple Plaintiffs or Defendants, you may simply list the first Plaintiff or Defendant.

Provide identifying information for the attorney or party completing the Case Cover Sheet.

If you are filing the initial Complaint, the Court will enterthe case number and division on the Cover Sheet. If you are filing a pleading in a case that already has an assigned number and division, provide that information.

Step 2:Complete Item 2.

Indicate whether the case will proceed as part of the Civil Access Pilot Project under Chief Justice Directive (CJD) 11-02. Participation in the pilot project is mandatory for cases meeting the applicable criteria. For your reference, CJD 11-02 is available at:

Check the first box if ALL of the following statements are true:

  1. The filing date for the caseis on or between January 1, 2012and December 31, 2013.
  2. The case is filed in District Court in Adams County, Arapahoe County, Denver County, Gilpin County, or Jefferson County.
  3. The case is a “Business Action” as defined in CJD 11-02, Amended Appendix A.

Check the second box if ANYof the following statements aretrue:

  1. The filing date is before January 1, 2012 or after December 31, 2013.
  2. The case is not filed in District Court in Adams County, Arapahoe County, Denver County, Gilpin County, or Jefferson County.
  3. The case is not a “Business Action” as defined in CJD 11-02, Appendix A.

If you checked the first box for Step 2, the case is governed by the Rules set forth in CJD 11-02 – skip Step 3 and proceed to Step 4. If you checked the second box, the case is not governed by the Rules set forth in CJD 11-02 – proceed to Step 3.

Step 3:Complete Item 3(onlyif you checked the second box in Item 2).

Indicate whether the case will proceed under the simplified procedure contained in C.R.C.P. 16.1.

Check the first box if BOTH of the following statements are true:

  1. The case is not a class action, forcible entry and detainer, C.R.C.P. 106, C.R.C.P. 120, or other similar expedited proceeding.
  2. No party seeks a monetary judgment over $100,000 against any other single party. In calculating this amount, include possible attorney fees, penalties, and punitive damages. Do not include possible interest and costs, or the value of any equitable relief sought.

Check the second boxif EITHERor BOTHof the following statements aretrue:

  1. The case is a class action, forcible entry and detainer, C.R.C.P. 106, C.R.C.P. 120, or other similar expedited proceeding.
  2. A monetary judgment over $100,000 is sought by any party against any other single party. In calculating this amount, include possible attorney fees, penalties, and punitive damages. Do not include possible interest and costs or the value of any equitable relief sought.

Check the third box if a Rule 16.1 Stipulation (opt-in) or Notice to Elect Exclusion (opt-out, JDF 602) has already been filed in the case according to C.R.C.P. 16.1(d)or 16.1(e).

If you checked the first box for Step 3, the case is governed by the Rules set forth in C.R.C.P. 16.1.If you checked the second box, the case is not governed by the Rules set forth in C.R.C.P. 16.1 and the case will proceed in accordance with C.R.C.P. 16 and 26. If you checked the third box, the case will proceed in accordance with the indication on the Stipulation or Notice.

Step 4:Complete Item 4 (optional).

You can request a jury trial and pay the requisite fee at this time. If you check this box, your filing fee must include the $190.00 jury demand fee. Please refer to C.R.C.P. 38 for your right to request a jury trial and waiver of the right to a jury trial.

NOTE: If you are making a jury demand pursuant to §38-1-106, C.R.S. (re: eminent domain), a jury demand fee is not required for a jury of six freeholders residing in the county in which the petition is filed. However, if you are requesting a jury of freeholders in excess of six (including alternates), an advance deposit of $50.00 per extra juror for one day of service is required. For example, if you demand a jury of 12, an advance deposit of $300.00 ($50.00 x 6) is required.

Step 5:Sign and Date Civil Case Cover Sheet.

The attorney or party completing the Civil Case Cover Sheet must date and sign it.
