Summary: Conveyance of 100 hundred acres of land in Norfolk County, Virginia from John Wallis, Jr. to Anthony Curling, Jr. for the sum of 10 pounds lawful money of Virginia. The indenture is to honor a commitment made by John Wallis, Sr., to Anthony Curling, Sr., before the former's death. The sale is made for the consideration of a loan granted to Anthony Curling, Jr., by the seller, John Wallis, Jr. Title to the property has passed to John Wallis, Jr. through his mother, Johanna Wallis. In the description of the property, reference is made to the adjoining property of Anthony Curling, Sr. The indenture for the purchase price is due one year after the conveyance. This indenture made the nineteenth day of November in year of our Lord God one thousand seven hundred and forty six and in the twentieth year of the reign of our Sovereign Lord George the Second of Great Britain, France and Ireland ???? between John Wallis Jr. of Norfolk County Colony of Virginia of the one part and Anthony Curling Jr. of the same county of the other part Witnesseth that the said John Wallis for and in consideration of the sum of ten pounds current lawful money of Virginia to him in hand paid before the sealing and delivery of these presents the receipt hereof he doth hereby acknowledge and himself therewith fully satisfied doth ???? and discharge the said Anthony Curling Jr. his heirs etc. and every one of them I have bargained, granted, sold, alienated, released, and confirmed and by these

presents do grant, bargain, sell, alienate, release and confirm unto the said Anthony Curling Jr. in his actual possession being by virtue of bargain and sale to him thereof made for one ---year by indenture bearing date the day before the date hereof and by force of the statute for loans ???? uses into ossession and to his heirs and assigns one tract or parcel of land situate lying and being in the County of Norfolk containing by estimation one hundred acres of land be it more or less Beginning at a corner gum tree standing in Anthony Curling Sr pasture and turning thence up an old line to a white oak standing

on the land that the said Anthony Curling bought of William Wallis thence running ???? a white oak standing in John Sikes line thence running down an old ???? to a beach standing on the swamp side thence bounding on the swamp to the first mentioned tree which hundred acres of land ???? left by John Wallis deceased in his last will and testament to be used to pay his debts and ordained and authorized his wife Joannah Wallis to make good the sale of the said land which he bargained with Anthony Curling

Sr. for and did and did not acknowledge the said land in her lifetime and as the property thereof is now fallen into the hands of the said John Wallis Jr. doth hereby acknowledge all the estate, right, title, claim and demand that owed of him the said John Wallis of and in unto the said land and every trust and ??? thereof and wherein he has any estate of ???? or inheritance in possession reversion remainder or executrance and ??? the estate right title inherit claim and demand and whatsoever of him the said John Wallis in or unto the said transfer or any trust thereof to have and to hold the said land and transfer hereby bargained and sold with this and every of their appurtenances unto the said Anthony Curling

Jr. his heirs and assigns against it the said John Wallis or his heirs and assigns and all and every other person or persons Whatsoever lawfully claimed right in title to the before mentioned granted transfers or any part thereof shall and will forever warrant and defend and the said John Wallis for himself his heirs Executor and ??? he doth covenant promise and agree to and with the said Anthony Curling, Jr. his heirs

and assigns that he is lawfully and rightfully seized of and in the aforementioned land and transfers with the appurtenances for a good sure lawful and absolute estate of inheritance in fee simple and his good right to convey the same unto the said Anthony Curling Jr. his heirs and assigns at all time forever

hereafter ????ly and finally to hold occupy and enjoy the said land and all other the hereby granted with the appurtenances without any manner of ???? trouble and interruption of the said John Wallis his heirs or assigns or any other person or persons whatsoever In Witness whereof the said John Wallis has hereunto set his hand and seal the day and year first above written

In the name of God, Amen I John Wallis Senr. of Russell County and Commonwealth of Virginia being weak in body by reason of old age and other infirmities, but perfect in mind and memort thanks be to God for all mercies; and calling to mind the mortality of my body knowin that it is appointed for all men once to die, etc, do make constitute and appoint this my last will and testament that is to say principally, first I recommend my soul unto God who gave it and my body I recommend to the earth from whence it was taken to be buried in a decent christian manner and form without pomp or vanity at the discretion of my executor in hope of a joyful reurrection by the almighty power of God, and as for what worldly estate it has pleased God to bless me with in this life I give and bequeath in the manner following: First I request all my lawful debts to be punctually paid. 1st Item. I give all my lands to my two sons John & Howard Wallis, the west end of my land I want John Wallis Jr. to have from a conditional line made by me and a fence made on the s'd conditional line and from said fence the east end of land I want Howard Wallis to have. 2nd item. I want my wife Elizabeth to have her support off of said land & I want John Wallis Jr. to see that she gets her support off of said land as long as she lives and take care of her and she is to keep her house and home if she chooses as long as she lives, and I want her to have her bed and furniture, and two cows and other household furniture such as she may want to keep for her benefit and use as long as she may live - And the ballance of my personal property I want to be equally divided between my five daughters. I do hereby order constitute and appoint my son John Wallis Jr. to be executor of this my last Will and Testament ratifying and confirming this and this only to be my last Will, revoking disannulling all and every other or (There appears to be a line missing here) bequeathed by me made confirming this the last. In witness whereof I have hereunto subscribed my name and affixed my seal this the twenty eighth day of March one thousand eight hundred and forty one.

At a Court of Quarterly session held for Russell County on the 8th day of November 1842: This instrument of writing was exhibited in Court as and for the last Will and Testament of John Wallis Senr. deceased, and proven by the oaths of John Lockhart and Valentine Miller two of the subscribing witnesses thereto and ordered to be recorded: and on the motion of John Wallis Jr. executor therein named who made oath and together with James Fletcher and Major A. Fletcher his securities entered into and acknowledged a bond in the penalty of $300, conditioned as the law directs, certificate is granted the said John Wallis Jr. for obtaining probat of the said will in due form.

Russell Co VA Court House Records

I James Wallis of Russell County and State of Virginia do hereby make my last will and testament in manner and form following, that is to say:

1st. I desire that so much of the perishable partof my estate be immediately sold after my desease, and out of the money arising there from all my just debts and funeral expense be paid. Should the perishable part of my property prove insufficent for the abouve purpose then I desire that my executor here in after named may sell my house and land lying in the County and State aforesaid, and out of money arising there from pay and satisfy such of my just debts as shall remain unpaid out of the sale of the perishable part of my estate.

2nd. After the payment of my debts and funeral expense I give to my wife Mary Wallace a sorrell horse and to have a maintenance from my farm and the use of my house during her widowhood or natural life.

3rd. I give to my daughter Susannah (which she now has in possession) one bed and furniture a cow and calf, one oven and one flax wheel.

4thly. I give to my daughter Margaret (which she now holds in possession except one oven) one bed furniture one cow and calf, one oven and flax wheel.

5thly. I give to my daughter Jane, one bed and furniture, one cow and calf, one oven and flax wheel.

6thly. I give to my daughter Nancy Lou (or Lea), one bed and furniture, one cow and calf, one oven and a flax wheel.

The furniture of the beds I give to my daughters sahll be equal to the furniture of bed I gave to my daughter Susanah.

7thly. After the decease of my wife I desire that my land other property remaining shall be equally divided among my three sons, William, Logan, and James.

8thly. I give my son James my bright bay mare, and lastly, I do hereby constitute my two sons William and Logan executors of my last will and testament hereby revolking all other former wills or testaments by me here to fore made.

In Witnesseth whree of I have here unto set my hand and affix my seal the 16th day of September 1824.

McFarlane the subscribing witnesses thereto and ordered to be recorded. And on the motion of William Wallis and Logan Wallis Exec. therein named, who made oath, and together with John Fletcher, Henry Fuller and Samuel Bromley their securities entered into and acknowledged a bond in the penalty of $500 conditioned as the law directs, certificate is granted the said William Wallis & Logan Wallis for obtaining probat of the said will in due form.
