Fair Trading (Safety Standard) (Babies' Dummies) Regulations 2007

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to prescribe a safety standard for babies' dummies.

2Authorising provision

These Regulations are made under sections 34 and 165 of the Fair Trading Act 1999.

3Definitions

In these Regulations—

the Act means the Fair Trading Act 1999;

AS 2432–1991 means the Australian Standard 2432–1991 "Babies' dummies" as published by Standards Australia on 15November 1991;

dummy means an article used to pacify a baby, which article includes a teat which the baby sucks but from which the baby does not obtain fluid.

4Prescribed safety standard

For the purposes of section 33(1) of the Act, theprescribed safety standard for dummies is AS2432–1991 as amended in accordance with the Schedule.

Regulation 4

Amendments to AS 2432—1991

AS 2432—1991 is amended as set out in the following clauses—

(1)Omitclauses 3, 5, 6.3, 6.4.2(a), 7.2, 7.3 and 7.4.

(2)OmitAppendices A, D, F, G and H.

(3)In clause 6.1 omit—

"and 6.3".

(4)In clause 6.4.2—

(a)in paragraph (c)(iii) for "25mm"substitute"15mm"; and

(b)in the Note at the foot of the clause for "25mm"substitute"15mm".

(5)Omit the Notes at the foot of clause 6.4.3(c).

(6)For clause 9.1substitute—

"9.1 GeneralThe pack shall be legibly labelled with the name and address of the Australian manufacturer or Australian distributor.".

(7)For clause 9.3 substitute—

"9.3 Warning noticeThe pack shall bear a clear and legible warning notice which shall include the following words or words that have the same meaning:

WARNING

DO NOT TIE DUMMY AROUND BABY'S NECK AS IT PRESENTS A STRANGULATION HAZARD.

In the warning notice the word 'PACIFIER' or 'SOOTHER' may be substituted for the word 'DUMMY'.".

(8)In Appendix C—

(a)for clause C2 substitute—

"C2 PRINCIPLEA dummy is placed centrally on the test template with its major and minor axes aligned with the major and minor axes of the template and the teat protruding down through the opening. Aspecified tensile force is applied to the teat in an attempt to force the dummy through the opening in the template. If the dummy is not forced through the opening in the template, the dummy is inverted and the procedure repeated.";

(b)in clause C3—

(i)in the title omit"AND REAGENT";

(ii)for "and reagent are"substitute"is";

(iii)omitclause C3(b); and

(iv)for the second paragraph of clauseC3(c)substitute—

"The test template shall have inscribed on it the major axis (I) and the minor axis (II).";

(c)in clause C4 omit "shall be representative of the batch and";

(d)in clause C6—

"(d) Place the dummy, teat down, in the opening of the template as shown in Figure C2, so that the major axis of the shield aligns with the major axis I-I of the template and the minor axis of the shield aligns with the minor axisII-II of the template.";

"(j) Place the dummy, teat up, in the opening of the template as shown in Figure C3, so that the major axis of the shield aligns with the major axis I-I of the template and the minor axis of the shield aligns with the minor axis II-II of the template."; and

(v)omitparagraph (m).

(9)In Appendix E—

(a)in clause E2 omit"immersed in a wetting solution and then";

(b)in clause E3—
