Agreement of lease

  1. It is agreed that the lessor shall provide storage facility to the lessee for the period commencing

on ………………………………. and ending on ………………………………………………

  1. The rental amount on the storage facility agreed to be R…………….. per month or part thereof.
  2. Payable monthly in advance as a binding agreement.
  3. The rental amount is to increase at a rate of 10% per annum from the month following the first

year after singnature of this agreement.

  1. The parties agree that the physical address as set above to be respective domicilium Citandi et

Executandi for service of all notices and or pleadings.

  1. Notice of cancellation must be given in writing not less than 30 (thirty) days before vacating of

the leased storage unit.

  1. The lessee shall have the option to renew the lease period.
  2. The lessee shall be liable for comprehensively insuring his/her stored goods. The lessor shall in

no way be liable for any damage or loss of the lessee’s goods by whatever cause. The lessee shall be responsible for the storing and recovering of stored goods from leased storage unit.

  1. Storing and recovering of goods are only to be done within normal office hours. Visits to storage unit outside normal office hours may only be done is arranged with lessor.
  2. The lessee may not store inflammable explosive, perishable, illegal or dangerous goods or any items which could be hazardous in any way.
  3. The lessee acknowledges the lessor’s residual hypotec in respect of outstanding rent which has become due and payable.
  4. The lessor undertakes to inform the lessee of any accurrence which could have been the cause of

compromising the integrity of the storage unit leased by the lessee to enable the lessee to inspect storage for damage to his/her stored good.

  1. Interest will accrue at a rate of 20% per month on arrear rental.
  2. Should the legal action be instituted against the lessee for recovery of arrear rental or for whatever reason, the lessee shall be liable for payment of the legal costs on a scale as between attorney and own client.
  3. Should the Lessee fail to pay the rent for a period longer than 3 months without notice to the Lessor the Lessor has the right to sell the lessee’s goods for arrear rental costs.

The parties by their signature hereon consent to the jurisdiction of the magistrate court and further acknowledge that they have read and understand this agreement and consider the contents thereof.
